If you can prove that the telco provides higher quality lines to their
customers, FROM THE SAME CO IN THE SAME AREA - yes, I'd say that is a case.
Best of all would be if one of your customers on a Mode 2 SLC calls them
and gets service and suddenly starts getting higher connect speeds,
especially PCM connects. If the telco is so underhanded as to upgrade
the lines for their ISP customers, you could nail them to the wall with
a good lawyer. If the customer can prove they were changed from Mode 2 to
Mode 1 (integrated) when they switched to the telco ISP, something stinks.
