I see the below information on Diamonds web site.

Your K56flex modem only has enough memory to support one protocol at a time -
either K56flex or V.90. If you upgrade before your ISP does, you will be limited to
modem speeds of 33.6Kbps and below. If this happens, reflash your modem to a
previous version of firmware per the instructions for your operating system. Note: If
your ISP is using Livingston PortMaster 3 equipment, they are currently unable to
support V.90 for Supra 56K modems. Use K56flex connections when dialing into
this equipment for now.
