This will only connect in V.34. In the past, anytime I have seen the _ACF_
in the ati3 stream, the modem is NOT upgradeable to V1.0. I would DEMAND a
modem exchange from Hayes.

In it I have some links (that will change over time) to modem vendors web
sites for flash upgrades. At the moment it seems BestData, and Supra have
beta versions of V1.0 code available. Beyond that, this is what I know for
sure about V1.0 code:
