I respectfully ask you to rethink what you are calling
"marketing hype".

If Dodge says the Viper has a V-10 engine in advertising
it better have a V-10. Anything less than
supplying a V-10 creates significant legal
liability. Telling people thay aere stupid
for buying into "marketing hype" is not relevant.

Seller should not tell buyer thing sold
has a V-10 if it does not. Period.

If the modem sellers say V.90 means
you can "connect at high speeds no matter who
made them" I guess they could claim the
statement is true if you believe
the reader accepts the reference to
"high speed" to mean 33.6K non-pcm
connections, just like their five
year old V.34bis or K56 (not V.90)
modem can.

But of course any
reasonable person would read those words as
meaning if brand X is V.90 and brand Y is
V.90 both could, under good conditions,
potentialy connect at above 33.6 speed
to a V.90 ISP.

You tell me that it is "accepting marketing hype"
for a user to believe a V.90 Zoom and a V.90
USR might both possibly connect to a V.90 ISP
at more than 33.6K. I say it is simply
the buyer believing what the seller is stating
as a fact about it's product before folding
up the buyer's money and putting it in
back pocket.

If the answer is "of course, given time
V.90 USR and V.90 Zoom will do . . . "

the answer is do not claim V.90 is a
standard among different brands today.

Finally, I suggest any business respect
their customers and their customer's
customers. I hope it is not Livingston
or Lucent position that end users of
their equipment are fools, to be lied to,
etc.
