Have the telco tweak the digital padding on the DMS-10.
Here's the instructions that Kyle posted a while back.
Fixed it for us. We get 40k to 46k on a DMS-10.

Here it is, hot off the presses. After working with Livingston and
Nortel, we have come up with the requirements to make it work.

Of course I have to warn you, your mileage may vary.

How to do 56k in a DMS-10 on CT1 E&M Wink Start

Trunk to Line padding is hard set to 2db in a DMS-10.
Trunk to Trunk padding should be set to 4db.
Line to Trunk padding should be set to 0db.
DNIS set to 1 digit. 0 digits does not seem to work properly.
The translation is specifically DIOD in the switch.
