56kflex response on non-56kflex modems

We've currently put a new pm3 up at one of our pops, and no one with a
56kflex modem can connect. According to tech support at Diamond this is
being cased by the Livingston modems saying they can do 56kflex during
the handshaking process even though the do not.
If this really is so, how can I fix this while waiting for the new 56kflex
modems to arrive?
